Title: Understanding the TCPA and Related State Laws: From Basics to Recent Developments

This session will explain the basics of compliance with the federal TCPA and related state standards, including do-not-call, consent, exceptions and safe harbors, and penalties. We will also discuss recent TCPA developments, including the impact of recent U.S. Supreme Court decisions on TCPA private actions.



Speaker: Michael Goodman, Hudson Cook, LLP

Michael A. Goodman is a partner in Hudson Cook’s Washington, DC office, where he has     spent 20 years developing a deep understanding of federal and state consumer protection laws. He advises clients on compliance with the requirements enforced by agencies including the Consumer Financial Protection Bureau (CFPB), the Federal Trade Commission (FTC), and the Federal Communications Commission (FCC), offering practical guidance on the standards governing telemarketing, text message and email marketing, online advertising, direct mail, and other forms of consumer contact. His clients—among them mortgage lenders, debt settlement firms, lead generators, auto finance companies, and personal loan companies—turn to him to build business strategies that reconcile inconsistent federal and state standards, to represent them in agency investigations and enforcement actions, and to advise on the proper collection, use, and disclosure of consumer information.

Before joining Hudson Cook, Michael served as a staff attorney in the FTC’s Bureau of Consumer Protection, where he helped develop amendments to the Telemarketing Sales Rule, managed the initial rounds of CAN-SPAM Act rulemaking, and litigated cases involving fraud and deceptive marketing. That experience as a federal regulator, combined with his years in private practice, gives him an unusually broad perspective in an area where the answers are rarely black and white; seeing an issue from the regulator’s point of view helps his clients assess risk and make informed decisions.

Michael considers listening an underrated skill for outside counsel, and his engagements typically begin with a conversation about the client’s business and vision for success. Because federal marketing standards carry penalties often disproportionate to the conduct they regulate, he encourages clients to consult him early in the planning process—an approach that lets them put marketing ideas into action with minimal disruption while supporting growth and innovation.
